Tax filing doubt - filed 1040!!

Hello desiOPT,

I think I have ran into some problem here. Last year I have filed taxes using freetaxusa website and after filing I realized that the form 1040 was filed instead of 1040NR. Please help me how to rectify this mistake.

1. Can this be rectified?

2. If yes, how?

3. If no, when will this create a problem in future(H1b, GC)?

Yes, there is a some sort of problem in your filing. You can rectify your previous mistake by taking an amended return. It may create some problem in the process of green card.

You can file an amendment. Use any consultant or tax lawyers for more info.

not a problem .. If u r indian u wont get any non resident deductions .. As tax treaty does not have any benefits for income tax .. ( this is only for income tax not social security tax )

Not a problem file 1040X along with 1040nr. Pay off the difference if there is.
