  • OPT extension pending (Change of employer)

    Hello All

    I am currently on 12 month period, ending on August 31[SUP]st[/SUP]. I have applied for an OPT extension in the first week of June. The USCIS has received my OPT STEM extension package, and my application status is under initial review.

    I have a few questions:

    a) Will my [B]OPT stem[/B] extension [B]application date[/B] become invalid if I submit the amended I-765, with new employer information.

    b) Does changing an employer now reflect in any way on my OPT stem extension decision by USCIS.

    Any advice and suggestions are welcome. Thank you all for the help and support.

        As per ICE.gov

        8.4.3. Can the student change employers while the 17-month extension application is pending?
        Yes. However, if the 17-month extension period has started, the employer must also be an E-Verify employer. The student must
        report the change in employment to his or her DSO. The DSO must update the student’s employer information in SEVIS and the student should submit an amended Form I-765 to the appropriate USCIS Service Center, providing the new employer’s E-Verify number and a copy of the USCIS receipt notice for the first Form I-765. A brief letter explaining the submission should also be included. There is no fee associated with submitting the amended Form I-765.
