  • Incorrect Stem OPT Base Fee

    All,
    I applied for my STEM OPT Extension on Jan 12th and it reached USCIS on Friday Jan13th( Phoenix Location). My application had the base fee amount 380$ instead of 410$. It has been almost 20days I did not receive neither my case number (i-797c receipt notice) nor got documents back( like other cases I read in the pervious form of an incorrect amount.)
    My OPT end date was on Jan 30th. Right now I'm on 60 Days Grace period, with no case number to track the status.
    1. Can I send a new application in 60days grace period?
    2. Am I eligible to continue my work now?
    3. What if my existing application gets rejected or it is going to taking more time to know the status? What would be my options to maintain my status? Am I still legal to work without a case number updated?

    All suggestions will be appreciated. Thank You

      1. No.
      2. Technically, until USCIS rejects or denies your application you are authorized to continue working under the 180 day rule for STEM Extensions.
      3. It’s not a matter of if, it’s a matter of when. Your application WILL be rejected for having the wrong fee. You should expect to receive the rejection in the next 1-2 weeks.
      4. As you have entered your Grace Period, the only way to remain in F-1 status is to re-enroll in school.

          Call uscis and let them know the issue .

          It is always recommended to apply 3 months before your opt expires to reduce problems .
