  • Cancelling OPT while in "Pending" state

    Hello guys,
I would seriously appreciate some help from someone who has been through a similar situation. I submitted an application for OPT in November 2016. I just checked my status on the USCIS website and it says it is pending. I want to cancel my application but am afraid that it might be too late and might just mess up the whole process. I got accepted into a STEM degree for this spring. If I cancel my OPT now, what effect would it have on my STEM OPT application later on? Could I be denied and lose out on the OPT entirely? Some help...

Though I haven't been through a similar situation, based on my understanding of OPT I think I can answer your question.
You can cancel your opt by sending a withdraw request for I765 to USCIS. However, the withdraw request must be processed before your pending I765 is approved.
So If I were you, I will contact my DSO as soon as possible for withdraw the opt application.

If your opt application got cancelled before it's approved, it won't affect the application after you complete the STEM degree in future as long as you are eligible for Post-OPT.
However, if your opt is approved before it's cancelled, there is no way to cancel or refund the unused opt period in the future.
You have to use the post-opt you requested in Nov. 2016.
