  • OPT Application

    Hi Everyone!
Currently i am doing MBA and graduating on Dec 17, 2016.I wanted to apply for OPT and we have college protocol to get our documents checked by our academic adviser and they make copy of my all I-20s and I-94, keep one copy for them selves and prepare one envelope with everything to mail it to USCIS.
I have got my documents checked by adviser on Nov 11,2016 she gave me an envelope to mail USCIS and she issued new I -20 stating OPT requested.
Now the thing is that i changed my mind and now i want to transfer to some other college with STEM degree so that i can get benefit of STEM extension.
I will probably get acceptance letter from new college before Dec 17.
I have not mail anything to USCIS yet.I didn't notify anything to my adviser either that i haven't mail anything to USCIS and i am transferring to other college cuz i am still waiting for acceptance latter from the other college.
1.Does any one have any idea that if college update to USCIS from their side that i am going to apply for OPT even if i do not mail my documents to USCIS?
2.My college have issued new I20 in November stating OPT requested,Can it will be a problem in transfer?
3.If i am not able to get acceptance letter from other college i want to transfer,is it still possible to apply for OPT from my current school or it will be too late for me now cuz i am already graduated?( I have selected my OPT start date as around 2nd week of January,2017).
4.Lucky if everything goes fine for me and i manage to get transfer from my current school and my adviser cancel I-20 requesting for OPT,will there any problem in getting OPT after STEM program from new college because of this mess?

Will appreciate your valuable time for replying on this post.

    Thanks

Your only option is transfer to new college. You cannot apply for OPT from current as you have surpassed the 30 days time limit. Whenever college releases an I-20 it goes into the system and USCIS has a record of the same.

Sending docs to USCIS seems a little out of place. My question is what is USCIS going to do with them? SEVIS has instead created an online system for universities to upload student information. Your college should be using that. USCIS may need info when you are applying for EAD through i765. You can transfer to a Stem program. See if you can use any of your current credits in new program.

Unless you apply for OPT you are not in the system. Please note there are 1.2 million students in a year in F and M status.

New OPT should not be a problem, but that is what your SEVIS record reflects now. When you move to new college you get new OPT and SEVIS record will be updated.

If you fail to get the new college, you will have to check with your DSO if the i2O is valid. They typically ask to send an i20 that was issued within 30 days.

You should do the transfer to new school keeping your current school in confidence. There is no thing like I20 cancellation. The college can always report to Sevis if a student is not following the rules set in place. (Please note : not a legal advice )

            Hello everyone,

I am in urgent need for help guys. I applied for OPT and 2 months later got a RFE- as it turns out, my DSO forgot to include a copy of my passport page in my application package. I am extremely worried as I am not entirely sure whether I should be reissuing a new I-20 (in order to make sure I don't pass the 30 day window of filing), or whether I should just send the passport copy that they asked for. I heard about many people forgetting to sign I-20 or I-765 and having to get reendorsed and refile the entire application. Please advise, this is keeping me up at night.

It’s too late to file the OPT application with USCIS. It’s been more than 30 days since the DSO signed the I-20. If you were going to file for OPT, you will need to get a new I-20. You can file for OPT up to 60 days after your program end date.

You need to let your DSO know about your decision to transfer as the DSO at your current institution has to process the transfer from their side as well.
