  • converting visa from f1 to h4.

    Hello there,

    I am on F1 visa Opt expires 8th jan -2017.I did not find any job till now.So I am not eligible to apply for opt stem extension.For staying here in USA, I submitted my documents for change of status (F1 to H4 ) to my Husband's employer last week.They told it will take 6-8 months to approve my h4 visa.

    my questions:

    1) can I stay here till my h4 approved?as my current visa status expires coming jan 2017.

    2) Is there any chance to apply for h1b in masters quota for coming april 2017?

    3) My husband is looking for job change.if he got a new job in next few months,can I resubmit my documents along with his h1 visa transfer documents to speed up my h4 approval?

        It should not take 6 to 8 months. My wife did the same n she got approved in 2 months

            1. Yes, you may remain here while the H-4 Change of Status is pending.
            2. Yes, your employer can file an H-1B petition on your behalf. If you have a U.S. master’s degree or higher, you are eligible for the Advance Degree quota.
            3. You should discuss this with an attorney. You may be able to submit an H-4 extension petition, but it cannot be approved until your current Change of Status petition is approved. Alternatively, if your husband is planning to submit a change of employer petition before your F-1 expires, you can withdraw your current application and re-apply with his H-1B.

              Have you applied you COS from F1 to H4. Is so Can you please share the required documents needed?
