  • RFE on OPT requesting Form I-20

    Hi All,

    I have submitted OPT application to USCIS on 12th August' 2016 forgetting to sign I-765 form, they returned my application on August 16th asking me to Sign the document and sent it back. I sent back the documents signed on 25th August.

    However, they sent me RFE notice on 2nd November stating "[B][COLOR="#0000FF"]Please submit form I-20 endorsed within 30 days of filing form I-765 with USCIS and within 30 days of the date the Designated School Official made the recommendation for Optional Practical Training (OPT) in SEVIS. This should be the form I-20 issued when your DSO entered the recommendation for OPT in SEVIS on July 20, 2016[/COLOR][/B]"

    Please assist what i should do now ?

    Do i have to get a new I-20 from my University with a new date, because initial date on my I-20 is July 20, 2016 ?

    And What documents Do i need to resubmit?

        You need to consult your dso / iss advisor and get a new i 20 prepared and also adjust the opt dates accordingly.
        Not to be nosy, but you received the returned I 765 on Aug 16 and you sent it back on Aug 25.. You wasted 10 days to just sign.. You could have avoided an rfe..

          As your I-20 was signed more than 30 days before the I-765 was filed (which is when you sent it back), then your OPT application will be denied. Getting an I-20 now won’t work because the I-20 must be signed as of the date your application was filed with USCIS.
          The only option you have, if you’re still eligible, is to withdraw the application and re-file. You should speak with your DSO immediately.
