RFE - Bonafide Employer-employee relationship

Hi all,

RFE issued for bonafide employee-employee relationship

Q1: Planning to send response with I983 having only consultancy name and location(NJ) and no client info, employment verification letter (with start date, payrate and job description), paystubs in a different state (MA). What are my chances of getting approval?

Q2: Can I switch to a full time direct employee job during RFE provided I send my new I 983, I 20 and offer letter from the new job?

Q3: If mine gets rejected, can I start CPT? If so, please suggest some day1 CPT around Boston, MA.


Thanks in advance. Anyone in similar situation and got approval please do respond. Any help is highly appreciated.

Hi. My case was processed by the Texas Center. The RFE should go to the VA Potomac.

Ok..I am in a similar situation. Where you able to contact any lawyer for the same? Or heard back from anyone in a similar situation?

I did contact an attorney. But there wasn't much he could do. In my case, my contractor would not include the client's name or location in the I983 or employment verification letter. Without that info the chances of approval is less, according to my attorney. Hence trying to find a new job as a direct employer. My deadline for RFE is Dec 14th. I did hear about people who have got approval by just having contractor's name and location on I 983 and employment letter and some by including client info too. The first case works for IT jobs I guess.
