  • URGENT! SUGGEST! 24 month OPT-STEM extension Request for initial Evidence I797 notice

    Hello,

My online case status is showing that on October'5, a packet was mailed to me requesting for evidence. I've been checking case status everyday. But only yesterday, it showed me at there's an RFE on my application. I haven't received any material regarding RFE. If my Stem-OPT gets declined, I won't have any grace period left to work on filing something else again. My question is, before any failure happens, can I enroll into some course to keep up with my status? While this Stem Application is in process, please suggest anyother way to keep my status alive.

    Thank in advance.

You need to contact USCIS as soon as possible if you have not received your RFE. As it has been more than 30 days, they can put in a Service Request and re-send the RFE to you.

From a common perspective, I don't see why you think your rfe might get invalidated and stem gets rejected.. Let's say it's just random fear factor for now.. I suggest you get to a day one cpt colleges and if ready to shred some bucks, get details.. If your fear comes true, you'd have all the details in hand and can join instantly not loosing any time..

Set your address right with USPS, and request USCIS to resend RFE notice...and then reply within stated deadline in the notice, and you should be fine...

I had the same issue. Here is my advice: Firstly, call uscis and tell them that you haven't received the packet and that they should resend it to you, which they will. They can also fax the RFE to you(they faxed me mine, upon request if you ask them to transfer your call to their manager). Secondly, Usually the time frame to reply to the RFE is 2 months, so you still should have time. The crux here is: Just call uscis and update your address(if changed) and ask them to resend you the RFE letter. Not a big issue. Good luck!

I would suggest you to check your college emails? My RFE notice(hard copy) was sent to my college and uscis website showed the old unupdated status then... Ideally one has 90 days to respond back to RFE. Please send all the documents as instructed in your RFE. Do not panic. All the best !
