Driving Lyft/Uber on CPT/1st OPT/OPT Extension/H1

Hi,

I would like to know that if a student is working with Lyft/Uber on CPT/ 1st OPT and his payroll is generated on SSN, What will be the effect on his upcoming OPT 24 months Extension and future H1B and GC filings? Will any of these will approved or denied or will get RFE?

Please write in steps for
a)1st OPT (if a student is working on CPT student and worried about 1st OPT )
b) OPT Extension 24 months (if a student is working on 1st OPT and worried about Extension)
c) H1B ( working on H1B and worried about status and GC filing)

As long as driving is a work experience which will fulfill the objective of your course work on CPT and comply with all the regulations on OPT i.e., directly related to major, minimum hours, not replacing American jobs, etc., you should be fine. Break any of the rules and you have serious implications in the future which might lead to deportation.

Long story short. Just don't. Look for a genuine job.

Irrespective of what status you are, you are not allowed to drive Lyft/ Uber.
1 & 2) Your payroll should only be generated if the work you are doing is related to your field of study and your employer is an e-verified company.
3) Your payroll should only be generated by your employer who has filed for your h1 (or currently holds your h1 in case of h1b transfer).

Unless driving for Lyft or Uber is part of a research project, don’t do it. You will be found in violation of your OPT or F-1 status. You won’t get the OPT extension and you won’t be able to change status to H-1B.
