  • Rejected 7 months OPT extension

    Hi All,

    Here is my a summary of my situation.

    At the end of July, I sent I-765 form with my signature and I-20, ect to my international office adviser for applying 7 months opt extension. (my OPT will be expired in Feb, 2017) ,
    On 2nd/August, my adviser sent all documents to USCIS.
    On 2nd / October, I sent an email to USCIS for asking about my application status because I had not heard anything from USCIS for 2 months.
    On 19th/October, I got an email from USCIS that my 7 months OPT extension application was rejected because of no signature on I-765 form. the email inform that if I wish to refile, I need to submit new I-765 form. Right after I got the email I called my international office adviser but could not reach to her because she is on vacation.
    I am sure I signed on the form. Unfortunately, I have not copy of the form that I sent to my international office adviser.

    Anyway, my question is that if the USCIS informs to resubmit, could I re-apply for 7 months opt extension although the deadline for 7 months opt extension was in August? Is there any possibility to be considered my application as missed deadline?

    If anybody to know how USCIS rules for resubmitted application, please let me know.

        Your dso can help in this case.. Do they keep a copy??

          If the email from Uscis says that you can file it again then you should. Make sure you get all copies this time and submit your application asap.

            You cannot refile as the window to file has passed. The only recourse you have is to file a Motion to Reopen if you think they denied it wrongly or if it was the DSO’s fault. You need to get the actual Denial notice and you need to talk to the DSO.
