  • Stem extension opt - rfe

Hi. I have applied for my STEM extension on July 7 2016. My case has been accepted and routed to the USCIS Potomac Service Center for processing. My OPT ended on July 12 2016. I had been working with my employer since November 2015.

I received an RFE from USCIS ON Sept 20, 2016 asking for the correct name of my employer and the E-verify number. While applying for STEM Extension I wrongly entered the employer’s EIN number instead of E-verify number. Now I came to know that my employer is not e-verified. Though they are changing to e-verified now, I have been working in this company after my EAD expiration date of July 12.

What will happen if I respond to the RFE with the E-verify number now.? What are the chances of USCIS accepting/rejecting my STEM application? Is there anything I could do about this now?

Your application will most likely be denied as the company was not E-Verified as of the date the application was filed.

Probably not. You have violated the laws by working for a non-everified company during your STEM extension.
