  • Changing employer while OPT Extension application is in process with USCIS

    Hello,

    Right now I am working at client side from consultant. I have applied for STEM extension based on my current client and consultant. Recently, I am in conversation of other company (full time) and they are willing to hire me. If I decide to accept that position, once I update the records of this new job with my school, would there be any problem with STEM extension application already pending with USCIS ? Do I need to sign new I-983 from new company ?

    Its possible,I was in the same situation
    Was working for a Consultancy, After May 10 my OPT application was pending and RFE was issued asking for 24 month i20
    I changed employer while OPT application was pending got i983 signed by new employer and sent amended I765 to USCIS ,my extension was approved
    But keep in mind when you change employer report your university ASAP ,sevis will be updated and be extremely carefull while sending docs and following all timeframes.

        Each time you change company, the new company must fill out the I-983 and you must submit it to the DSO. A change in employer should not affect the EAD application, as long as the new company is enrolled E-Verify.

          My situation is some how similar.
          If we update the new employer details , Dso will enter the new employer into sevis.
          Will these update may delay out extension processing?
          Or instead should we have to wait till the extension is approvedby luck , then we can update?

          By any chance if I get an RfE , at that time Can i update my new employer details with new I983 and submit them to dso and submit necessary documents to Uscis?
