urgent-status on cap gap

Hello all,

i got my h1 picked this year and got an rfe the reply on which still am waiting to hear..Its almost oct 1 and i have my cap gap i 20 till september 30

My questions are :

1.will i be out of status till i get my h1 approved ..if so should i get my i 20 from my college with expiry date extended...if so what should be my expiry date..please suggest

2.should i register for cpt to be on status

3.what are my options now to fill this gap....

please help me with your suggestions..

You will not be out of status as long as the H-1B is pending. You will not be allowed to work though, unless your OPT is valid beyond Sept. 30.

1) you can stay in us but cannot work till your h1 gets approved 2) you might have reacted little earlier with day one cpt university and discontinue after your h1 gets approved .

I guess cap gap is active till you get a decision on your h1b status

You cannot work After Sep 30 , but can legally stay in US !
