  • Need help with form I-983 - employer+staffing agency complications

    Hi,

    I'm filling the form I-983 for STEM extension but things are a bit complicated so need some help here.

    I got a job offer from an employer who was not e-verified at that time and was using an external e-verified staffing agency to do my payroll, insurance, and similar formalities. As I'm not allowed to use the staffing agency's e-verify details, my primary employer got e-verified (yay!). I'm helping my manager with the form I-983 not but it's getting confusing.

    - As my payroll, insurance, and similar formalities are going to be managed by the staffing agency, should I put them as my employer including their EIN in the Section-3 (Employer Information) of the form I983 and provide my main employer's details (where I'll be working) in Section-5 under Employer Site Information?

    - If the above is true, where should I mention the e-verify details of my main employer?

    - In the worst case, if USCIS asks for more details like payslips and I provide them payslips issued by the staffing agency, would that create a problem?

        You should be putting all your employer's details in the I - 983 not the details of the staffing agency.

        You mentioned the below line:

        Normally all the big employers run their payroll system through ADP and insurance through major insurance providers like Aetna, Cigna, UHC etc.

        Hope this clears the air.

          I'm in the same situation as well and need help. I have already submitted my staffing comapany's details as my employer in the ISSS-160 form to the university before. please guide me now on how to apply for stem extension. thank You.

            Who said you can't work from a staffing firm? Until you have a employee and employer relationship it is fine and after all it's the school who reviews your 983.

              You send the I983 to USCIS. along with other docs. Anyway, I just filed for STEM EXTENSION and filled out my i983. I used the following sample filled out by immigration attorney as a guide http://m.desiopt.com/.../Can-IT-Cons...Companies-Hire...
