OPT Extension- They should receive before one month of sevis record update.

  • OPT Extension- They should receive before one month of sevis record update.

    Hi all,

    My OPT extension start date will be on Jan 5 2017. So, I should apply to the USCIS after OCT 5 2016 only. In Sept 8 2016 I have applied to university for OPT extension I-20. They have approved it on 12th of September 2016. Since there is a rule that we have to apply to USCIS within 30 days after the Sevis record gets updated by DSO my question will be if I post the packet on 5th Oct 2016 and send them to USCIS through overnight delivery where as USCIS receives the packet by 6th Oct 2016. Will there be any problem to me.


    USCIS should receive my packet before 12th of September 2016, Which date do they consider, The date of which the courier man delivers the packet or the date at which USCIS confirms the receipt ?

    As per my understanding , with your situation..... if University prints STEM OPT Extension I-20 on Sep 12th then it has to be sent along with your I-765 application package on or before Oct 11th to USCIS.

    USCIS considers date of receiving the application as per my knowledge not receipt which it prints as acknowledgement.

    If you're confused better apply after few days with New Form I-20!!

      Hey Pratap, Thanks for your reply, And one more final question. Since my start date is on Jan 5th is it mandatory that we should send the packet after Oct 5th or is it ok if we send the packet before 5th also.

        You can send application before October 5th but it has to be reached at USCIS on or after October 5th

            1. 90 days before January 7, 2017, which is presumably your OPT expiration, is October 9, 2016, NOT October 5.
            2. Please check the information from USCIS regarding OPT extensions. According to https://www.uscis.gov/working-united...bility_for_the, the I-765 must be filed “within 60 days of the date your designated school official (DSO) enters the recommendation for OPT into your Student and Exchange Visitor Information System (SEVIS) record” NOT 30 days.

            You should have your package delivered to USCIS no earlier (or later to be honest) than Monday October 10 to be safe. Also, if you’re worried about the I-20 going stale, then get a new one but according to USCIS, it’s fine.

                Correct me if I am wrong do we need to apply 90 days or 120 days before regular opt date expiry ?? Because as per my knowledge it is 120 days

                  Please get the I20 reissued by DSO.. And apply within 30 days.. one of my friends got his rejected because of the 30 day window

                    Why? He will get 2 months after issuing the I20 by the dso, see here https://www.uscis.gov/.../students-a...yment/stem-opt

                      Yes I am able to see it in this page now. But my friends petition was rejected outright and he could not work on opt because of that.. Sharing my personal experience

                        Can you point me to the link where it says that OPT application should be submitted within 1 month of SEVIS? I also have similar dates, but i am aware that the application for extension should be submitted after the school issues a new I20

                          This 1 month is wrong. Look here https://www.uscis.gov/.../students-a...yment/stem-opt. So you will get 2 months aftet I20 is issued for the submission. Disagree?
