Opt extension

Hi Everyone!

My employer is reluctant to fill and sign the I-983 form. I think they are just scared because they have not done this before. It is a small and growing company and they are just over stressing this issue. I am even scared they may fire me any moment. My current OPT expires in Jan 2017. And I have to apply by October to meet the 90 days criteria if you want your application to be processes and approved before the current card expires. What can I do.

My DSO does not mind recommending the STEM Extension. But USCIS requires E-Verify number when filling the Form I-765. I am confused and I don't even know what to do. I am not sure if I can get a new job before October.

there is nothing much to get scared .ask your employer that you are working at the employer location and he is training you .but keep in mind when uscis comes for the visit you should be available at the employer location .this is what most employers are doing and i have seen cases approved

how is a consultant working at client site in Texas available at a random unannounced surprise inspection at employers office in New York?

Employer should have a system ready for the employee and when uscis comes the employer should say he is sick Uscis will say will come tomm for inspection by that time employee should be available same thing happened in fremont

Try to convince ur employer, also there is no 90 day rule for stem extension as far as I know. Your stem application documents should reach uscis (and you should get the i797c preferably) before your current opt expiry date. 90 days is the time period when you can start applying for stem. If the current employer is hesitant try to find a job by December and file stem u should be good!! Best of luck

You have to apply for opt extension 120 days before not 90 days.
