  • Filing for MTR i290b gives me any status...???

    My first opt denied and I have filed for mtr i290b .my case status says that " we updated your name for your form i290b, notice to appeal to commissioner".
    Its been 90 days and still pending and same status. I want to know whether I'm legal to stay or not because my case is still processing.can I wait still my case gets approved or i need to apply for second masters for safety .I'm not understanding what to do.please give me your feedback so i can go for further steps.

      You are legal to stay till your case is solved. Mtr petitions take almost 180 days to finish processing. apply for second masters if you think you mtr petition couldn't change your opt denial.

        thankyou for replying..!! I think it should be approved this time because i have submitted some supporting documents from school too..but problem is my status..some of them saying that you will be in legal till ur process,and while others saying you are not. Im in confusion.

            As long as your case with USCIS you are legal to stay here and try to take New i20 ASAP.

                is it.... but when i called my dso,they said that i can stay legal till its processing but you cannot work.....!!

                  You mean to say after OPT denied only 60days we can stay legally and rest of the days illegally? Even ur case is pending with USCIS? Just trying to understand

                    Till the case is pending you are legally allowed to stay but if u get denail again u will be out of status no grace period is given if you exceed 60 days from the date of application

                      MTR may take 6 months or more than that. It's not legal to stay if your MTR is in process. Talk to your school DSO and see other options. You will not acquire unlawful days if your visa type D/S. But it may affect your MTR decision if you stay longer without any status.

                        Yes bro i spoke to dso and they are saying that you can stay legal still your process but you cannot work.....!! but im not sure whether they are saying right or wrong......
