Never received the initial copy of RFE and past the deadline to respond to RFE

My application for STEM OPT extension for 17 months was received by USCIS on March 22nd and it was transferred to another USCIS office on April 4th. [B]Till date the same information is reflected on USCIS website.[/B]

I've contacted USCIS customer service on August 04 th and requested them to expedite the process, since it's gone past 120 days. I've received a mail today stating they are unable to expedite my request as they are waiting for my response to a RFE and they have also attached the copy of the RFE. I never received the initial mail about the RFE.

The RFE stated that I need to submit a new I-20 for 24 months OPT and the documents must be received by them by August 13th. It's gone past the deadline to submit the documents and I'm worried if USCIS will approve my request if I respond to the RFE now.

What is my next course of action? Any advice and suggestions will be greatly appreciated.

The one thing I know about USCIS regarding deadlines is - If your application is in pending status and they did not receive your documents before the deadline, they take the action accordingly, that means they reject the case due to lack of evidence. Talk to an attorney asap. Good luck

You must respond to the RFE immediately with the required documents and attach an affidavit confirming that you never received any RFE from USCIS in the first place and that the first time you even heard about the RFE was when you received the correspondence from USCIS.

It is very odd that you waited this long to put in an expedite or service request as OPT applications are supposed to be processed within 90 days.
