I completed my Masters (IT) in May 2016 and got a job in a American Start-up company related to my field of study.
Because of me they enrolled into E-Verify, they have in-house projects for multiple clients and running my payroll with minimum wage (20+ hours a week). They are ready to file for my H1B sponsorship in next April 2017 and sign for my OPT extension in next year. I will be the first person for this process. My CEO said, he will hire an Attorney for my OPT extension and H1B process.
Recently I came to know that, company should have paid 3+ years taxes in order to sponsor H1B. Is that true? I am not sure since how many years they are running the business. I asked my senior, he said that long back they registered company with different name then I think 1-2 years ago they renamed company name.
Can anyone please explain me "what is minimum eligibility criteria for failing H1B?" Is it good to continue working as I have some chance to grow up or else will it be any risk to work in small American IT consulting start-up companies. Please suggest me.
