  • Applied for 7 month extension, H1 denied

    Hello

    I hold master in computers and working in same field as a consultant. I am also on STEM Extension(17 months) which will be expiring on Dec 4, 2016. I completed my project in May 2016 and My employer applied for H1 petition under the client at that time. My project unexpectedly ended in May and and I was unlucky to get RFE. It will get denied by this month as attorney was not able to answer. So I am waiting for that result. On the safer side I also applied for 7 month extension while submitting I983 form with my employer details and client details while I was on project. My packet reached USCIS on July 1, 2016 before my deadline date and it still says processing while I check online.

    1.Now that I got a new project at different location with new client, Do I need to update I983 with my same employer name but different client and send it to school? will that affect approving my extension as it is already in process.

    2. Now that my 7 month extension is in process, my I765 has my details and new I20 generated by my school has three sections
    a. my employer location
    b. my client location / physical location which is different from employer location.
    c. and H1B status showing PENDING

    Also I am sure my H1B petition will be denied (I am just waiting to get update on it) will USCIS/DHS will looks at my case closely and consider my file for 7 months approval? AS I am more concerned about H1 section mentioned on my I20.

    3. Now if I send updated I983 ( which I am not sure I should send or not as my employer is same only client is different) to school then may the university will ask me to send new I20 to USCIS for my extension with updated information mentioned in above question no. 2 as a,b and c. Then there will be a problem?

    i think since your client has changed, your working site also changed that means you will have to do a new i-983, as it clearly says any material change needs to be reported. my suggestion would be, do a new i-983, get new i-20, send the new i-20 with new i-765, and you would be fine. you dont need $380 again.
