  • Respond to stem opt rfe or no - h1b approved and got cap-gap

    I have applied for STEM OPT extension and got a RFE requesting new I-20. My OPT expired on 06/11/16. In between my H1-B application got picked and is Approved. I got new I-20 with the cap-gap extension details from the University. So, now that my H1 is approved and I got CAP-GAP extension till OCT1 should I be good with Cap-Gap or should I respond back to RFE which I got for STEM EXTENSION ?
    What will happen if i do not respond ? (USCIS will deny my application and I will not have any prob right) or will there be any Prob ?

        It's totally your decision. I was in the same boat and I did respond to rfe just for renewing my license.. But if you don't want to go ahead with responding to rfe, inform uscis about it and update your h-1b approval with university. Cheers !!

          If you are sure that you will be starting your H-1B job on October 1 and you no longer want to pursue your OPT STEM extension, respond to the RFE with a letter telling USCIS you are withdrawing your application.
