    Hello ,
    I applied for my OPT on April 28 and till today it has been 104 days and I have a job offer and my case still says "Case has been received". I have asked them for expedite processing but nothing is being updated. They tell me to wait for the status to be updated.I have the following questions

    1) Since I have a job offer can I work till my opt decision is in pending status ?
    2) What are my options?

        1. You must wait for the OPT to be approved.
        2. Have you actually put in a Service Request for the delayed processing or just asked for expedite? You may also want to seek the assistance of the USCIS Ombudsman.

          Sorry to carry the bad news. Unfortunately, you can not work until you get the OPT card. Its best to work with your employer and postpone your joining date.

            I don't think you can start working without the EAD card. Frankly you should have it by now or USCIS should have taken action to expedite since it's past 90 days. I had mine expedited but it took a week to update and by then I actually had the card mailed and received in hand. So if they have told you that they've expedited, it should be under process most probably.

              Is it fine if we keep our opt start date as 20 days after graduation and we receive our opt after the time period of 60 days which exceeds the time limit between graduation and opt start date.?

                Your 60 days grace period starts from the day your opt card is approved.

                  What kind of documents do you require to expedite your case? My case was received on July 12 and a week later, I got an offer letter from a company. Start date is Aug 16. I would like to put in an expedite request but I am not sure what documents they'd require besides the offer letter.

                    There needs to be financial loss if they don't hire you within the date. If so they can write a letter on that premise.
