  • OPT Extension, Two Different Degree In the USA , E2 Visa(Green Card)

    Hi everybody,

    I have three troublesome questions about immigration rules on an F-1 visa in the United States. I am in the United States on F-1 visa( Study visa) and have earned the Associate degree in Computer Science from Community College. After the graduation, I have applied for Post-OPT which is like getting Work authorization card (EAD) from the government. I just sent the required application documents to the USCIS Phoenix Center last week. So my application is in the processing, and I will get EAD for one year within 90 days.I have three concerns going on in my mind.

    The Question No. 1 ) I would like to know if can I get the OPT extension after my first year of EAD card Expires? Because according to the OPT rules, my field is related to STEM. But I am not sure that I could be eligible to get the extension since I have earned the associate degree which is lower in level compared to (Master's or Bachelor's degree). So please contribute your opinions I want to know your views on this subject I am worried about it? My DSO does not much know about OPT or CPT because I am only one international student in the college and the first case to him applying for OPT.

    The Question No 2) After OPT period I planned to continue my education and joining four years US Institution and earned Bachelor Degree in DIFFERENT MAJOR WHICH IS BUSINESS ADMINISTRATION THAT IS NOT RELATED TO STEM. After that, I will again apply for OPT. So during that time can I eligible to work in IT companies? Because at that point, I will have Associate in Computer Science and Bachelor in Business Administration.I want to know your views since both the degree I would be earned from the US institution so, in that case, would I get opportunities to work in both field related Computers and Business? And Can I eligible get OPT extension if I had not got on Associate Degree level.


    The Question No 3) This is an extraordinary inquisition. I have heard that F-1 holders can be self-employed and can start their own business on OPT but the work should be related to a degree they have earned. My uncle has 5 Franchisee Food Business in the USA so what if I received Bachelor in Business Management and during OPT Can I apply eligible to apply for EB-2 investor visa which is getting Green Card? I have done research on this topic since I am from India I will have to invest more money in the USA. But what if he sells the two stores to me? Is this considered as the investment? Can I apply for EB-2 visa?Please let me know so I can touch base with a qualified immigration attornies.

        1. In order to be eligible for a STEM extension, you need to have obtained a Bachelor’s, Master’s or Doctoral degree (https://studyinthestates.dhs.gov/17-...stem-extension).
        2. As you yourself have stated, your work must be related to the degree. If the occupation you obtain at the IT company is related to your Business Administration degree, then you should be fine.
        3. Yes, those in OPT status can be self-employed. There is no such thing as an EB-2 investor visa. There is E-2 investor visa but only those from certain countries qualify for the E-2 (http://www.visapro.com/e2-visa/e2-investor-visa.asp). Indian nationals cannot qualify for the E-2 visa.

            No OPT extension for associated degree
            You will get new OPT for new business degree if it is higher level than associate degree

              Can I get OPT extension on Bachelor degeee though it is not related to STEM ? Please read Question No 2.

                OPT extension is only for STEM graduates. Ask your school if you degree qualifies for STEM

                  I am an immigration attorney and have assisted several clients with investment, family and business immigration questions. EB-2 is not the investment visa. It is EB-5. It requires an investment of either $500,000 or $1million - depending on where you invest - in a new commercial enterprise.
