OPT Extn in processing but I got job offer(Perm),What to do?

Hi All,

I was working with an e-verified consultancy and I applied for OPT extension through them, however once my OPT got expired they asked me to resign. Since then I started looking for full time opportunities, and I recently got an offer. I want to ask if I can join them as my OPT extension is still in processing and my previous OPT got expired. If yes, then what documents can I submit as a proof of employment authorization once I join them. Also can anyone suggest me any alternatives.

You can join a new employer. The new employer must be enrolled in E-Verify. You must notify your DSO and you need to give your DSO a Form I-983 from the new employer as well. Your proof of employment authorization is your expired EAD card and the receipt notice for your OPT renewal. You are authorized to continue working for 180 days.

Update the new employer in the univ first and show them i797 notice of action and show them that u can work upto 180 days when the ext is pending( most of the employers diesnt agree) but give a try

U can legally work for 180days while ur decision for ur STEM is still pending.

You can work for 180days if you got your extension receipt. And mean while you need to update your dso with new employer info and get and new i20 which has new employer info. Send i-765, new i20, opt extension receipt and explanation letter for changing employer while extension is pending to USCIS.
