Hi,

I have a question about the OPT to H1B application.

If the OPT expire before the H1B application date, can I still apply for H1B. I have OPT which will expire on 15th March 2017, will I be eligible to file H1B application for 2017.

You will be allowed to file for an H-1B petition because you will still be in your 60-day grace period. You can remain in the U.S. until the H-1B goes into effect on October 1, but you will not be allowed to work until the H-1B is in effect.

Yes you can. But will not come under the CAP-GAP category. Precisely, you will not be able to work from the OPT expiration date to October 1st if your H1B is selected and approved.

In this case you can be in us and enroll in a school to continue you status... If picked you will have a h1 status and can start working from 1 oct... Good luck

You will not fall under cap gap as your opt is expired before the filing.. Good luck...

Opt expiration has nothing to do with your h1b application. The only condition is you need to main your legal status after opt expires till oct 1 if your h1b is picked in lottery and approved.
