Who should fill I983? Everified employer or Non-EVerified client?

  • Who should fill I983? Everified employer or Non-EVerified client?

    I was initially hired by a Non-Everified company (CompanyA), reputed and very much related to my field of study. Just that, they are not EVerified. Because I had to get the STEM extension, the same Non-EVerified company set me up with another employer who is EVerified (CompanyB). I continue to work at the CompanyA *as a contractor*, but I am a full time employee of CompanyB (With salary and benefits).
    CompanyB is more or less a consulting company (Small with only 25 employees) since they only run my payroll, give benefits, but all my work and my location is still CompanyA. Both CompanyA and CompanyB are very close in location and in the same city. Also, two more employees of CompanyB work in CompanyA with me as contractors (But they are americans and they are senior)

    My Questions are,
    1. Who should fill out form I983? Everified employer (who is a consulting company) or Non-EVerified client (Work related to my major) ?
    2. Who should be my supervisor? Person from Non-Everified Client (Who is currently supervising) or one of the contactors (Who are employees of EVerified employer)?

        The company that you are doing projects for or the one who is providing you the training. For stem your employer who fills out the form need to be e- verified.

            In this scenario, Employer B is your employer and needs to fill out the I-983. However, USCIS has said that an employee of Employer B must be able to supervise you. Otherwise, the extension may be denied.
