RFE issued while applying for OPT (SEVIS was dated more than 30 dayes before the application date).

  • RFE issued while applying for OPT (SEVIS was dated more than 30 dayes before the application date).

    Hi. I am on F-1.

    Important dates:

    07 Mar: SEVIS(I20) date
    14 Apr: Application Received by USCIS(7 days late)
    18 May: Graduation Date
    27 Jun: RFE issued; states:
    'You didn't submit updated I20 with the DSO sign being within 30 days of app. filing date. Please submit updated I-20 endorsed within 30 days of app...'
    18 Jul: Completion of the 60 days period.

    Now I have been told that only solution I have here is to withdraw my first OPT app. & reapply with new I20 (because the I20 USCIS asked for,can't be produced). (Can I just not send the new I-20 with the new SEVIS request date?)

    Now, even if I withdraw my app., it takes 20-30 days for application to be dropped. By then, my 60 days grace period will be over (Jul 17).

    This means that I won't be able to reapply in time.

    What do I do? What will the best course of action be? I am very worried!

        Reply to the RFE with the withdrawal letter so that you are sure they received it. Immediately re-file your OPT application. You don’t have to wait for confirmation from USCIS about the 1st application before the 2nd one is filed.

          Hello everyone,

          I am in urgent need for help guys. I applied for OPT and 2 months later got a RFE- as it turns out, my DSO forgot to include a copy of my passport page in my application package. I am extremely worried as I am not entirely sure whether I should be reissuing a new I-20 (in order to make sure I don't pass the 30 day window of filing), or whether I should just send the passport copy that they asked for. I heard about many people forgetting to sign I-20 or I-765 and having to get reendorsed and refile the entire application. Please advise, this is keeping me up at night.
