  • STEM OPT deadline approach: Can I mail other materials first?

    I'm now waiting for my school to issue new I-20, but my deadline is approaching, and they said they have many other urgent cases to work on.
    Can I mail out other materials first and then mail my I-20 separately?
    In particularly, if USCIS receive a case without valid I-20. Will they ask for further evidence (REF) or deny it directly?
    I appreciate any comments in advance

          I'm wondering what can happen if I mail other materials first and the most recent I-20 with my current employment information on it? Will I receive RFE or direct denial?

            I believe it would result in a denial. Best to double check with USCIS.

              Your I-20 must be signed as of the date of application in order for it to be valid.

                1. First thing I am not sure why your school is neglecting your application. It is the DSO duty to issue a new I-20 if your OPT is approaching the end date. They cannot ignore your situation and say they have urgent cases to work on.

                Solution: You can reach out to an immigration attorney who can request the I-20 on behalf of you. I am sure your DSO should respond immediately atleast at that time.

                2. Did you apply your Initial OPT by yourself? Because your question was so dumb. I am sorry to say you that. How can you expect that USCIS will accept your application if you file the application without your new I-20 from the school?
                FYI USCIS will reject the application if there are any missing signatures on the present or previous I-20's and you were thinking to file the application without an I-20. Great!!!!!

                Solution: As I told you it is your right to get your new I-20 if your OPT is approaching the end date. Please have all the conversations with your DSO on emails. Because these are the proofs that you can prove USCIS/Court in case of any delayed OPT applications. But I strongly suggest you to approach an attorney if it is not resolved yet.
