  • My Employer is not allowing me to work with 17 months OPT i20 -- Need help urgent

    [B]Hi All,

    Need your help urgent, I have applied for OPT extension in April 2016 when 17 month opt extension was active, after OPT amendment to 24 months USCIS has requested for RFE to submit i983 form.
    I now have 17 month OPT i20 from school issued in April 2016, I am in the process to submit i983 to school, my current OPT expired last week. though my work authorization automatically extends for 180 days or untill my case at USCIS is adjudicated which ever is earlier, My employer is not accepting that he says until you have new i20 for 24 months, you will no longer eligible to work, I have time till august 14th 2016 to answer RFE. My employer is asking me written proof
    or an extra document to support my argument, is there any way I can show my employer that I am eligible to work, Please help.

        This is a link to the USCIS website: https://www.uscis.gov/working-united...yment/stem-opt. It states that you can work for 180 days while the application is pending. It was created/updated after the new regulations went into effect.

          It's policy. It's on the USCIS website. Your employer should know better. You could also try and get a status letter from your school.

            Talk to your dso and explain them your situation... It will work fine... Good luck...

              You shouldn't have to prove this to begin with. Your employer must know what you mentioned. Send him link of uscis website that explains the same thing. Also try to talk to ur dso and see if they can issue such a letter.
