  • OPT Denied for applying after 30 days grace period

    Hi,
    My OPT was denied for filing the OPT after the 30 days grace period...

    -Firstly DSO Approved my OPT i20 on "Dec 8th, 2015" and I filed for OPT on "Dec 22nd, 2015" then after USCIS Rejected my application on "Jan 6th, 2016" for sending the wrong dated check. And they insisted me to resend the application my making the necessary corrections(CHECK). They sent me a blue color letter with the documents and asking me to place it on the top of the application while resending the case.
    -I thought that by seeing the blue color letter on the top of an application they would consider the case as an old application, and I send back the same application with a new check with the correct date on "Jan 10th, 2016".
    -But they denied my application mentioning that application was filed after the DSO approved "30 days grace period".
    grace period --- Dec 8th, 2015 to Jan 8th, 2016.
    First time applied -- Dec 22nd, 2015
    First time rejected on -- Jan 6th, 2016.
    Resend 2dn time -- Jan 10th, 2016.
    They also mentioned that there is no appeal to this decision.
    1. If I file for a motion in this case, what is the success rate?
    2. If i apply for Motion will i be in the status?
    3. what are the best options that I have?

      I'm exactly in the same situation, in my case I forgot to sign the I-765 form.

      My dates:
      OPT issued --- Nov 11th, 2015
      grace period --- Dec 19th, 2015 to Feb 19th, 2016.
      First time applied -- Nov 30th, 2015 (arrived USCIS)
      Resend 2dn time -- Jan 6th, 2016. (arrived USCIS)

              Talk to your DSO and file MTR, you should be just fine.

                Talk to ur dso, get a new opt i20 and apply again as a fresh application.

                  I faced a similar problem, My application reached USCIS after the designated 30 days after the generation and approval of OPT I20 by the DSO and I received the denial after the 60 day grace period after program completion. My questions are the same as the OP:
                  1. If I file for a motion in this case, what is the success rate?
                  2. If i apply for Motion will i be in the status?
                  3. what are the best options that I have?

                  Currently I'm out of any legal status.
