OPT application -Question on cap gap extension

Hi All,


I have a question about OPT application and whether I will have cap gap extension. I will complete my course in May 2016 and OPT starts from May 30th onward. I have already used 2 months and 16 days as per-completion OPT for an internship during summer 2015 so I have about 9 months and 14 days of OPT left.

Since I applied for OPT starting from May 30th I will have until around March 14th 2017 for OPT period. And assuming if my OPT STEM Extension starts on March 15th 2017 and ends on March14th 2019 ( 2 years as per the new OPT stem rule). Here I have a chance of filing H1B in the years 2017,2018 for sure. My question is the possibility of filing H1B in April 2019 as a last chance if the first two didn't work out? (OPT stem extension is supposed to end on March 14th 2019) and so would cap gap extension be applicable for me?

Alternatively should I cancel my current OPT application to change the start date from 30th May?
Will canceling an OPT application have an effect on me in any manner ?
Please suggest if there are any other options available for me.

you should be in status not on grace period to apply h1 if your opt expires after april 1 you will be covered under cap gap till oct

Cap gap rules : if u are in grace period and applied h1 can only stay till oct if h1 approved or pending .
If u apply h1 when u have valid opt then u can work till oct if h1 is approved or pending .

If u do not have any h1 notice u can extend u r cap gap for 60 days using fedex receipt and i129 .

What if opt expires after April 1st around April 11th i.e. before lottery And in regular processing ?

Can we continue to work ?

Or

Just can stay ?

U can work .. if u file for h1.. u need to prove u r employer properly filed u r h1 ( ie fedex reciept and 129)
