Opt stem Deniel

    Hi,

    I am on opt and it is expired on feb 1st 2016 and my stem opt extension got denied on feb 22.I met an immigration lawyer who said its not a better idea to go for motion as it will definitely gets denied. The reason for denial is I sign my stem extension i20 after 30 days of issued date. It's due to my location change and lack of communication with my old room mates. My university DSO just send it with out checking all these as I have no idea about it. Some of them are saying I can work till April 1st which is 60 days grace period and apply for H1b. Is this correct? Or can I apply for motion to get any grace period to apply for H1b as currently I am working on a project. Please give me my options on this. Thanks in advance.

      Legally, you can no longer work in the US. You have 60 day grace period from the end of your original OPT to either leave the country or apply for a change of status (Enroll in another academic program or h1b).
      Since you are past the end of your OPT you can no longer apply for OPT STEM Extension.
      When did you apply for your OPT STEM Extension?

        Uscis received my stem opt application on December 4th

          I signed my stem extension opt I20 after one week it is issued.I.e issued on jan 10 ,2016 but i signed on jan 17 ,2016 and sent USCIS.Will there be any problem.Please advise.

                  Dude you should have a basic knowledge about opt and duties of international student when you are in opt, basic rule is you have to update your address and employer details to your DSO every six months... One more confusion thing is you mentioned your opt got denied because you haven't signed on i i20 in first 30 days ?
                  Why it is any thing to do with your sign on opt ???

                  Any how man enroll in to a collage there are plenty of collages for 2nd masters and get reinstatement and get cpt from day one.
                  Collages in Harrisburg and Virginia they allow cpt from day one. Good luck.

                    Opt packet has to reach uscis before 30 days of i20 recommendation make date .u have no option now to fix u r opt .
                    U have 60 day grace period . But u can not work u can just stay till apr 3.Using cap gap in u r situation is very very difficult. It depends on u r dso and employer timing.if they can make it then u can use cap gap to stay (not for work) if u r employer files h1 b ( cap gap end times may depends on h1 lottery results and h1 results ) .

                      Too much information is missing, did you talk to your DSO? Did you talk to USCIS? Did they ask you to file MTR? Did they tell you about your status? If not, please do talk to USCIS they will suggest you the best solution! In such situations, college will reissue a new i20 with latest date and apply for revise enrolled date to USCIS. Also, MTR should be the second ideal solution but, like I said too much information missing to accurately suggest you

                        Yes , i feel in most cases they give RFE so that you can give evidence.

                          on grace period you cannot apply for h1 .I think you cannot even work .60 days grace period is to make a decision whether to leave the country or join in an univ .MTR is an option but it will take time.I am not sure whether you can apply h1 .other option is join in day one cpt univ and apply h1 so that you need to study till oct 1 and then discontinue
