    Hi All,

    I am an international student who graduated on December 18, 2015. Recently, I received a denial notice stating that I-765 Form must be denied. The reason is that the submitted I-20 form which was issued on October 10,2015 was filed more than 30 days from the date of receiving my I-765 application. USCIS received my OPT application on November 10, 2015. Even though I submitted the updated I-20 document which was issued for Co-Op details on November 2, 2015, USCIS did not consider my latest I-20 for OPT application. The updated I-20 document which was issued on November 2, 2015 contain information about Co-Op and OPT request.
    In the same denial notice, USCIS mentioned about Motion to reopen or recover must be filed on Form I-290B to appeal for this denial decision.

    Please answer my following questions:
    1. What are the solutions for this problem ?
    2. How long will the Motion to reopen or recover process takes ?
    3. Is there any way to expedite the Motion to reopen or recover process ? Since, I have an offer letter to join as early as possible.

          File MTR and should take anywhere up to 90 days or may be more. Check with DSO if you expedite

            The information you provided in the post was confusing. Are you saying you submitted 2 I-20’s? One dated on October 10 and one dated November 2? If so, did the 2nd I-20 also have details of your OPT? If yes, then you have a shot at the MTR. If not, you are out of luck because October has 31 days and if USCIS received the application on November 10, more than 30 days passed since the 1st I-20 was issued.
