  • OPT extenion

My 12 month OPT ended on 17 Jan 2016. I received an RFE from USCIS on 20 Jan 2016 stating that the E-verify number I provided to them was incorrect. I confirmed with my hiring manager and they had provided me with the employers tax number. They thought it is same as the e-verify number. That's when I realized that the company which I was working for was not e-verified at all. My hiring manager promptly got the company enrolled for e -verify on 21 Jan 2016. I will resend the i-765 with actual e-verify number which I have now on the MOU.
Will this give me problems for extension ?

Yes, you will have problems. You had to file the STEM extension before your OPT expired. You can’t file a new STEM extension now. The only thing you can do now is to respond to the RFE with the E-Verify number and see if USCIS accepts it.

Legally, I think it might get denied. Better consult with a lawyer.
