OPT extension

Hello,

I am on OPT and my OPT expires on May 15, 2016. I think I can apply for 17 month OPTX 120 days before. My question here is do I need to apply for OPTX before Feb 12 ? Is it true if I apply before Feb 12 my OPTX get approved no matter what the upcoming court decision is ?

Not true. The court is yet to confirm if the vacatur occurs on Feb. 12th that it will NOT affect the legal status of F-1 students holding unexpired EADs granted under the 2008 rule.

UCSIS will continue to process OPT extension application until any final decision is made.. Make your application as soon as possible..

Err.. The court gave an extension on the stay of the vacatur till may 10. You should apply for stem extension as nothing changes till may 10.

So is it like we should apply before May 10 or get decision before May 10. What if I apply for opt extension in 1st week of May ?

if DHS doesn't implement the new rule by May 10th, no matter when you apply it will be invalid. If it does come up with the new rule, one of two things can happen: you get an EAD for 17 months and then apply for the rest of of the period with additional documentation or DHS asks for additional documentation and gives 24 months.
