I have been out of States for more than 6 months. Currently I am working for my US employer in India while I am still on OPT. My OPT is going to end in last week of January 2016. My question is that can I still file my OPT Extension from India as I don't want to travel to the States for my OPT Extension filing.

Since you are out of states for more than 5 months assuming they are consecutive, you are no longer on f1 thus ineligible for optComment

If your 6 months of stay outside the US is consecutive, that is a violation of F1 visa rules. Hence, your sevis must have been deactivated by now. You won't be able to apply for OPT extension now.Comment

If he is on US payroll, I don't think he would be out of status.Comment
