    I have a tough situation here. My student visa has expired in Jan, 2013. For some serious reason i was forced to travel to india in Dec,2012 inspite of my student visa expiration. But Im on valid OPT. So, right now im in india and i want to file H1 to get back to US. For that I heard from my employer that I need to have pay stubs which r not older than 3 weeks. But since I left to India 3months back, I don't have pay stubs since then. My client is ready to give me the client letter for the H1 processing. Now my question is, what is the probability of getting my H1 approved? By the way Im not working in software domain and i work for non-software employer.

    Your employer will know much better about it... He only can help u in creating pay stubs n all...

      This yr already more than 1 lakh applications hv been applied so u better b hurry... I heard dat ds time it's going to b lottery system if they receive more than the no.of visas they issue...

        Do you have an employer who has agreed to sponsor you for the H-1? Is it your first H-1B petition? If so, you would not be required to show pay stubs. Your employer could instead provide evidence of their ability to pay you the prevailing wage in the area of intended employment- they could provide a copy of their most recent tax return to provide evidence that they can do that.
