Hi my application for H1 B has been denied stating that I was unemployed for more than 90 days during my OPT period. I was doing voluntary unpaid internship with my employer during that period(I am on my OPT stem extention now). My employer and attorney says that as this is a USCIS finding of violation I have to go to my home country and go for VISA stamping.(I have valid F1 visa till july 2016. What do I do now?

It is quite surprising that they rejected your application. Did you furnish proof like your offer letter, inform your school's DSO on time etc?
I am currently unpaid intern working for a consultancy too. Is it necessary to run a payroll when you are working as a unpaid trainee intern?
