opt re-apply

Hi,

I recently got denial for my opt(I-765) ,my receipt number(LIN1591357521).

Actually the case is , i applied for OPT on june 20th, 2015,while applying i forgot to include my check($380) in the packet .I waited for 35 days but there was no acknowledgement from USCIS(i.e I-797) and I confirmed my application with customer service of USCIS but they did not find my application in their database and asked me to reapply without any confirmation.

So, i re-applied for OPT packet again on July24,2015,I got both acknowledgments (I-797) on AUG 1st,2015,one is stating that it is rejected(LIN1591251961) due to incorrect fee and please follow the instructions to re-submit and receipt for other application(LIN1591357521).

As I have submitted my 2nd application without the instructions mailed to me in the rejection notice packet,I got denial for my 2nd application too,this happened because i didn't got that rejection notice mail on time.

1st Submission :LIN1591251961 (without Check )
2nd submission :LIN1591357521 (without rejection notice letter,because I did not got it on-time,35 days delayed).

Please review my case and let me know what are my options to reapply again.

You should speak with an attorney. Are you still within 60 days of your program end date? If not, then you can’t re-apply, and you have no choice but to file a Motion to Reopen. In the MTR, you can argue that you were advised by USCIS to file a new petition as they could not find the original application in the system.

yeah , i'm in grace period. i have 5 days left but i didn't received my denial notice yet i'm waiting for that. my first i-765 application was rejected due to in correct fee details can i resubmit it now or after grace period.?
