    Hello all,

    I have a serious doubt.
    I recently got a job in company "B" and they filled an I 9 form for me. However, I worked for Company "A" for nearly 8 months and they gave me an 1099 form instead of a W-2 form. That means I was an Independent contractor and not an employee of that company. My doubt is that company A didn't file any
    I - 9 for me and I was not under any third party company.

    So, My doubt is
    1. Do I have to fill an I 9 form myself and report that to USCIS..??
    2. I haven't filled any I -9 form for my self. I can show enough proof that I have worked for the company for 8 months. I need to apply for my OPT extension next month. Will this cause any problem for me.


    Please help me with this.

        The employer must keep the I-9 for their records. It’s not something you need to fill out. Also, I-9s are only required for employees, and it seems that company “A” didn’t consider you as an employee.
