  • How do I transfer my approved H1B to a new employer before Oct 1st?

    I am currently on F1 OPT stem extension. It is valid until the July 2016. I have applied for H1-B visa this year April which was approved and is supposed to start from October 1st, 2015. Meanwhile my job with the employer, who has filed the H1 petition for me, has terminated. I would like to know which one of the following is the safest thing for me to do. Please suggest the best way to deal with this situation.

    (1) Apply for a H1-B transfer with a new employer before Oct 1st, 2015?
    (2) Cancel the H1-B petition through my ex employer before Oct 1st and resume with my current OPT?
    (3) My ex-employer is trying to support me by holding on the process of informing the USCIS about my termination until Oct 3rd. Can I apply for H1-B transfer after Oct 3rd?

    Please let me know if there is any other option that I can go for. I want to use the approved H1 instead of going for the quota the next year. I would also like to know the success rate of the H1B transfer before Oct 1st. Has anyone succeeded in transfering their H1B before it has even started?

          If ur current employer wont withdraw ur h1b before oct 1st
          Then u can apply for h1b transfer and u can work from now(if ur not in cap gap)

            Its very difficult to get picked in the lottery u r bit lucky ad transfer the h1 on oct 1

              You should speak with an attorney to see if it’s better to wait to file the transfer on or before October 1. Either way, you can begin working for the new employer now on OPT and then file the transfer on October 1.
