  • OPT STEM Extension RFE - Employment History - Unpaid Internship

    Hi everyone,

    I just received an RFE letter for my OPT STEM extension asking for the following:

    Employment History

    1. Letter from employer establishing job title, duties, location, pay rate, and number of hours to be worked per week,
    2. Copies of your earning statements/ pay stubs,
    3. Copies of your W-2
    4. Signed copies of job offer letters/contracts.

    If you worked for an employment agency or a consultancy, you must provide evidence of the jobs you worked on and dates worked. Additionally, if you worked remotely, please notate such in your employment history.

    My situation is that my initial OPT started from 07/14/2014, I worked for a company A as an unpaid intern remotely from another city during the period of 09/02/2014 and 04/27/2015, and I have been working for another company B full time since 05/04/2015. After researching online, I’m worried about my first unpaid internship may cause denial because I read somewhere that unpaid internship needs to be training programs. I have the offer letter and employment verification letter from company A saying that my job title there is consultant and that is an unpaid internship with 25 work hours per week. The job is mostly completing assignments from my supervisor with her instruction. The employment verification letter from company A has start/end date, job title, work hours per week, job duties, one brief sentence about my degree and job related to my filed and a few words mentioning working remotely in it. Is that enough or do I need more details? Do I need to ask for another letter saying something about training? As for company B, I have offer letter, employment verification letter and earning statements but I do not have W-2. Do I need to get an attorney for this?

          1. I would recommend getting a detailed letter from Company A regarding your duites. Ask them to mention 40 hrs instead of 25hrs/week which can be termed as part time job only. Whereas on OPT you are allowed to work 40hrs or more/week.
          2. It's OK to not have W-2. Just mention the joining dates and they will understand that a W2 has not been generated because you didnt work for them in 2014.
          3. Attorney you may or may not.If i were you, i will not hire one for OPT RFE.
          Paystub is must in OPT unless unpaid internship/job.

                I would suggested you to get an attorney , I have seen my frnds has got same kind of rfe's and got rejected due to inappropriate paper work submission.

                  I am in a similar situation. I joined a Consultancy in OPT period and I am currently unpaid because I am in training period. I will not be paid until I get a project.

                  My offer letter does not mention anything about pay, it is mentioned that I am a trainee software engineer working for 40 hours per week. I am getting trained online, I am in a city different from the one my company is in.

                  Even my University's form where I have to declare about the employment does not ask whether it is paid or unpaid position.

                  Given the scenario, how can I avoid any RFE during STEM OPT Extension regarding paystubs for unpaid duration? How do we declare during STEM Extension that I was working initially as an unpaid Full-time employee?

                    Hi,
                    I am in the similar situation. I recently got a job at a company and I was working in a consultancy earlier. In the consultancy, I was trained online, and was in a city different from the one my company is in and it was unpaid.

                    Will this be a problem? How can RFE be avoided? I am really worried after reading about this issue online. Please help me out...
