  • H1B not picked in the lottery - Other options for Multiple H1b applications next year

    Hi

    My OPT EXT is expiring this sept and my h1b did not get picked up in the lottery this year.
    I m going back to school and plan to get CPT and continue working and apply for H1b next year.

    My questions are:

    1) Does a F1 student have to be working on a project to apply h1b? if i am not on a project can i still apply for h1b?
    2) How to find employers who can sponsor multiple h1b's ? since my application did not get picked last year i want to put multiple applications for h1b next year and get h1b for sure next year

      1. If you work directly for an employer in-house, you don’t necessarily have to have a project to apply. If you work for a consulting company or a company that works solely on projects for other companies, then you may be required to have a project in place to apply.
      2. No single employer should be filing multiple H-1B’s – it is illegal, and it can get you and your employer in trouble. If you want to have more than one petition filed on your behalf, you need to find more than one employer to sponsor you. The less they are related, the better. Also, don’t have more than 1 employer filing an H-1B for the same end-client project as that can also cause problems.
      3. Be careful of working for CPT from day one – USCIS has been giving applications much higher scrutiny and giving RFE’s for those who worked with CPT from day one.
