  • OPT Extension grace period

    I applied for opt extension, and waiting for the decision.
    My Date of EAD opt expiry 15 June.
    When does the 60 days grace period ends 15th Aug or 60 days after the denial.
    After reading the guidelines and some of the universities website faq on OPT,what I understand is the grace period starts from the day of EAD expiry or opt end date.
    But after reading the forum posts , I got a bit confused as some people have been saying it starts from denial date.
    Is there any official statement which says that it starts from the denial date.

          If USCIS denies, rejects, or revokes an H-1B petition filed on behalf of an F-1 student covered by the automatic cap-gap extension of status, the student will have the standard 60-day grace period (from the date of the notification of the denial, rejection, or revocation of the petition) before he or she is required to depart the United States.

            grace period terminology will be the same either for h1 and f1 hope this helps

              In my experance as an International Admissions Officer at Sullivan University while you will have 60 days to leave the country, you may not have those same 60 to find another school. Likely your SEVIS will be put into complete status 60 days after the end of your OPT not 60 days after the rejection. School will be unlikely / unable to take a transfer of a student in a complete status. If you plan to maintain your F1 status in the case of a denial you may need to find another school immediately, and speak with your current schools DSO. To be honest you may have waited to long.

                How can the school change his SEVIS status if his OPT extension is pending? If it’s still pending, he continues to be in status, and SEVIS continues to be active until the denial of the STEM OPT application. However, if the STEM extension is denied, the grace period is still 60 days after the expiration of your OPT, NOT on the date of the denial, unless you have also applied for H-1B. This is why you should apply for OPT 3-4 months before your OPT expires. If your STEM OPT is denied, and 60 days of grace has already passed and there is no option to Motion to Reopen (USCIS made a mistake in denying the application, for example), then you should leave the country within 10 days.
