F1 extension while on OPT

Hi
I Am presently on post completion OPT and my f1 is expiring on aug 21st. How ever i need to travel to india this december and because my visa is not valid i cannot re enter US. Hence I want to apply for f1 again this december. What are the possible risks involved? I have a full time job and can submit all the documents required.

It is very risky to apply for an F-1 visa once you have entered your OPT period. This is why most DSO’s strongly advise against travel during OPT period if your visa has expired. The reason is that now that you are working, it is expected that you will try to remain in the US to work and eventually to apply for H-1B. Your intention to return to your home country is much harder to prove now than it was before.

If you are denied visa you cannot come back. Thats the only risk. Why risk losing full time job just to show off back home?

Yes, you can apply. Check out your eligibility for drop box option. If you are not eligible then go for the interview
