  • OPT extension applied without the latest I20

    Hello guys,

    My OPT expired on July 27. Due to some mis communication I didn't talk to the university about OPT extension and didn't get a new I20 recommending the extension. What I ended up doing is that I applied for OPT extension on July 5 with my older I20s and all other documents. I talked to the University on Aug 11 and they told me that my OPT has ended and and they can't issue me a new I20. Also, that I have a 60 day grace period. I have the following questions:

    1. What is most likely to happen to my application ? RFE or rejection.
    2. Is there anything that I can do now to make amends to the application?
    3. What are my options to stay in USA?

        Steps in Applying for STEM Extension

        Student submits the STEM Extension I-20 Request form to OIS. Processing time is five business days at OIS.
        Students who have already applied for the STEM Extension I-20 and have received the I-20 from OIS but have changed employers can report their employer information using the OIS OPT Employment Information form and then submit the I-20 Request Form to OIS for processing.
        The earliest that students can apply is 120 days before the end of the 12-month OPT. Applications must be received by OIS no less than 30 days before the current 12-month EAD card expires.
        OIS will mail STEM extension I-20 to student in pre-paid envelope provided by student.
        Student will then send a copy of pages 1 and 3 of the STEM Extension I-20, new I-765 form, application fee, photos, and all required supporting documentation before the EAD card expires. Please see the The Checklist for the Extension Application for more details.
        USCIS offers an e-notification of application receipt. Students interested in receiving an e-notification should fill out the Form G-1145 and include it as the first page of the extension application.

          to be safe side get a I 20 from another university which gives day 1 cpt .you may get an RFE to submit the stem I 20 which you cannot get from university now which may result in denial.or a direct denial .the chances of getting approved is very low

            You are yourself to blame. You did not follow the rules. Go back to your home country before the end of 60 day grace period.

              1. You will most likely get an RFE or a Notice of Intent to Deny, asking for the updated I-20 from your school. It will ultimately get denied as you don’t have one that you can submit.
              2. There is nothing you can do now.
              3. Enroll in another degree program before your grace period expires. Be wary of schools that offer CPT from day one - those have been increasingly scrutinized by USCIS and can cause you problems when applying for H-1B.
