OPT denied - F1 student

Hello ,

My name is Jayaram Chandrasekara Kumaran.

I got my OPT i20 on the date of March 11 2015
I sent my i765 on April 20 2015 and USCIS recieved my application on April 27th 2015
I got my EAD receipt on May 6th
They denied my application on July 28th because i forgot to send my application in the 30 day time period from the i20 date .
How can i get my EAD card and start my employment from here on ?

You will not be able to get OPT unless you are still within 60 days of your program end date. If you are still within 60 days, you should re-apply immediately with a new I-20. USCIS must receive the application within 60 days of your program end date.

If that date has already passed, then the only way you may be able to get the OPT is by filing a Motion to Reopen on the denied I-765 with an explanation that the delay in filing was because of something that was beyond your control. This would need to be something like a medical emergency or instructions given to you by your DSO that were wrong. Even then, there’s no guarantee of approval.
