  • bringing spouse to USA while on OPT

    Hi,
I just completed my undergrad degree in US. now im on my OPT and i will start my job from next month, august 2015. my visa is over and i will be on my OPT from now on. I am getting married this december. so my questions are following:

    1. under OPT, should i still be considered as an F1 visa holder? my F1 has expired since i had that for 4 years and i completed my 4 years of bachelor degree under F1.

    2. while on OPT, can i bring my wife to US? if so, what will be the procedures to be followed?

    3. we will have a registry marriage on skype, with both the parties present since i dont wanna risk my OPT by traveling outside. can this cause a problem to my wife while visa interview?

      1. Until your OPT is complete, you are in F-1 status. Has the F-1 visa in your passport expired? If it has expired, you will need to obtain a new F-1 visa when you travel in December. It is not recommended for you travel outside the US if the visa in the passport is expired as it is difficult to get a new visa. If the visa in your passport has not expired, you should have no issues traveling. Most F-1 visas are issued for 5 years.
      2. Your wife will need to apply for F-2 visa after the marriage at the US Consulate. The procedure is the same as the procedure you went through to get the F-1 visa. You will need to get an updated I-20 from you school advisor.
      3. Yes, this type of marriage is generally not recognized by the US government in most instances. If you have a valid F-1 visa in the passport, there is little risk in traveling.

if i marry via bideo conference, then my marriage will be registered in my home country where it is a common practice and legally accepted. in that case can it cause my spouse any difficulty while getting F2 visa?

            1. Under OPT you still be considered as F1 status holder. Your visa might expired but as long as you can maintain F1 status you can stay in this country.

            2. Yes you can bring your wife to USA, she needs to apply for F2 dependent visa.

            3. I'm not sure about it.

I'm sorry, but this sounds ridiculous to me. How can you get married via skype?
