  • Applying for OPT extension and new F2 Visa.

    Hello I am a F1 student currently working in my OPT which ends on Jan 21, 2016. I am eligible to apply for OPT extension too. I am planning to get married in first week of September. Due to some unavoidable reasons, I have to bring my girlfriend back with me when I return back (yes it’s a love marriage and her parents are against it. My parents are ok with me marrying her here in US or back in India). I have the following questions regarding the application of OPT extension and F2 visa.
    1. Is it advisable to travel during OPT. If so what all the documents should I need to carry during my travel.
    2. If traveling is advisable what would be the best time for me to apply for OPT extension (before I leave to India in September or after I return back from India)?
    3. Can I travel after applying for OPT extension and before I receive any result).
    4. What is the process for applying F2 Visa and what all the documents I need for it. And is there any possibility that the visa will get rejected.
    5. Is it better to ask her to come in tourist visa and get married here in US and apply for change of status? If so what would be the process for it.

        you can travel on opt i went to india and got married last month port of entry atlanta or dallas washington dc try to avoid rest travel i20 from univ 3 recent paystubs client letter and employer letter must 2) you can apply 120 days before 3)yes u can travel even after applying 4) marriage cerificate 33 000 dollars in you accound (depends on your univ) passport of your wife and get f2 i20 from univ attend interview 5)its a long process f2 is recommendable and easy to get rather than torist visa goodluck

                  If really it doesn't matter for you to get married in India , then it's better that you ask to come to USA and get married here and get her converted to h4 later

                    Ok. First of all relax.
                    1) it is ok to travel in opt period, provided u have a client letter/employer letter and ur recent pay stubs (just in case they ask).
                    2) apply fr STEM after u come back.
                    3) u can get married in india n get her here or ask her to come here n get married.
                    4) not really sure abt F2 process but rejections are rare unless ur girl/would be cant speak english.

                        I have travelled like so many times on my opt . Considering I have travel job . I didn't face any issues . In my port of entry they have checked my i20 and ead . And asked me what I do that's all . My entry has always been JFK. I advise you to carry letter from employer with recent date .

                          Yes.. you can travel on OPT.. for F-2 visa, you will need your would-be wife's I20.. your university should issue it.. some universities need marriage certificate to issue that I20.. some do not.. check that well in advance with your university.. if your university issues her I20 before marriage, make sure you take it with you to India..
                          For F-2, you will need marriage certificate, your valid I20 and your wife's I20, EAD, keep your pay stubs, employment verification letter, few marriage photos as proof
                          you cannot travel while your I20 exertion application has been submitted and is pending approval.. you can do it after you come back..
                          I was in exact same situation in february and everything went well.. let me know if you need any more details..

                            1. You can travel while on OPT as long as you have a valid F-1 visa. Applying for a new F-1 visa during OPT is extremely risky. The documents to carry while on OPT is the same as when you were studying (a Form I-20, endorsed for travel and signed by your DSO, and a valid passport with a valid F-1 visa), but also have your OPT card and proof of employment (employment letter and pay stubs) .
                            2. You need to wait to file the extension until after you return. You are NOT allowed to travel while the STEM OPT extension is pending.
                            3. Definitely NO. If you travel, you must travel before you file the extension or only after your extension is approved.
                            4. Your wife will need to apply for the F-2 visa at the consulate the same way you applied for F-1. Your school will need to issue an I-20 for the F-2 dependent, and she will need the copy of your OPT card and proof of your employment and of the marriage. She will also need proof that you will be able to support her financially (pay stubs) and that she has an intent to return to India.
                            5. What’s the basis for her to get a tourist visa?
